These trading terms apply for the sale and purchase of any goods from the website of Fotosounddirect.com.

These terms and conditions only cover Fotosounddirect's website and the sale of any goods from it. . Any other website to which you link from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites that are not under our control. Sales on this website can be concluded in English only.

If you wish to contact us with any queries regarding our electronic store, its products or services or any order you have placed, please contact us. Or you may click on the 'contact us' button on the homepage where you will find a 'feedback' form.

Age Qualification:
To be able to purchase from our web site there is a minimum age requirement of 18 years . By ordering on this site you are confirming that you are of the required age.

Copyright:
We, our Group of Companies and suppliers own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material is strictly prohibited.

You may not create any link to this website without prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.

Goods and Services Tax:
GST is Jersey’s ‘Goods and Services Tax’. The current rate is 3%; it is applicable on all goods purchased on our site for either delivery within the Island or for collection from our shop. Goods delivered to an address outside of Jersey are exempt from GST.

Ordering:
By ordering from this site you accept its terms and conditions. As these may change, without notice, you are advised to regularly check its content. The prices quoted on the site are an invitation to purchase;therefore Fotosounddirect.com reserves the right to withdraw any offer at its sole discretion.

After you submit your order we will give you an Order Reference Number and the details of the products ordered. We will send an email (first email) when we start to process your order. Your order reference and the first email are acknowledgements, not acceptance of your order.

Acceptance of your order occurs when you receive a second email containing collection/delivery details. Alternatively, we may decide to decline all or part of your order for any reason, in which case our second email will tell you so and how we will affect a refund.

The confirmation of acceptance of your order will list the goods purchased, payment made and pickup/delivery information (see delivery of goods).

Please note the site is not monitored weekends or bank holidays.

Special Orders:
Certain products that are not generally held in stock are available for special order only. In this instance you may complete the payment process whereafter you will be notified of the expected delivery date. Should the delivery date not be acceptable, or the goods due do not arrive by the quoted date, a refund will be made. If you do not wish to pay until you have been advised of an expected delivery date, you may contact us requesting a delivery date on a potential special order.

Payment:
This is made by Debit/Credit card types listed at the payment stage. Credit/Debit cards are subject to validation checks and authorisation by the card issuer. If the issuer refuses to authorise payment the order process cannot proceed. Fotosounddirect does not accept any responsibility for validation or authorisation of payment. Any refusal is between yourself and the card issuer. All payments are made via a secure Internet payment system that safeguards your data. Our system automatically checks the authenticity of your card details, however, in the event of unauthorised use of your card, most card companies cover your liability to the amount agreed in their terms and conditions.

Availability:
Availability is noted at the time of purchase. Where there may be an exceptional delay you will be notified by email or telephone to verify your acceptance.  Should any accepted order be cancelled following notification of exceptional delay or for any other reason, a charge will be made that will include any transportation costs that might be incurred by fotosounddirect.com.

Collection/Delivery Of Goods:
At the time of purchase you have two options:

1) To pick up goods from our retail premises ( Fotosound, 5 Charing Cross, St. Helier) .
Should you choose this option you will need to present your order confirmation together with photographic ID (passport/driving licence) and the credit/debit card used at the time of payment.

2) To have the goods delivered to your home address, which must be the same address as the credit/debit card that was used to purchase the goods. The delivered goods should be inspected and signed for at the time of delivery. Deliveries will normally take place between the hours of 09.00 hours and 20.00 hours, Monday to Friday. Contact will be made prior to delivery, except for smaller items which may be sent by post.

Fotosounddirect will accept no claims for any items that are found to be missing after 48 hours of delivery or collection of such goods.

Collection/Delivery Tariffs:
The tariff for any product is found by clicking 'Delivery' in the 'Checkout' screen and then clicking 'continue' to display the tariff.

Registration & account Login:
This allows for easier access should you wish to revisit the site. You are given the option should you wish to receive product or special offer information from us. Please see our Privacy Statement, sub heading, 'Personal Information Collection Statement', about the information that we collect from you and hold on your behalf.

Delivery Charges:
Charges are dependant upon the size and weight of the goods ordered. Should you decide to opt for delivery at the 'checkout', the specific delivery tariff is added. In the instance of a multiple product order, only the tariff for the largest/heaviest product will be added (i.e., single tariff only).

Non-Jersey residents:
Orders are accepted on a 'Collect only basis'. See above, 'Collection of goods'.

Return of goods:
A product may only be returned to us once it has been authorised by email and a 'RAN'  (Returns Authorisation Number) has been issued. Once you are in receipt of this 'RAN' the product may then be brought into our Store in Charing Cross. Fotosound cannot accept any product for return unless accompanied the 'RAN' document.

In the first instance complete our returns form stating your name, date of purchase, sales receipt number, product purchased, contact telephone and giving a description of the fault or reason for return. You will then be contacted by telephone or email. For your guidance, please see  'Returns Policy'

Disclaimer:
Whilst every effort had been made to ensure the accuracy of any information on this site, whether it may be technical information on products or the pricing of such products, Fotosounddirect will accept no responsibility for any inaccuracies and will accept no claims for such inaccuracies and reserves the right to withdraw from sale any products that are found not to be correctly priced; this will apply to any product whether prior to any sale, at the time of sale or up to and including confirmation of sale,  but not after delivery or collection of the goods in question.

Limited Liability:
If we do not perform our obligations to you within 30 days or other agreed timescale or we otherwise fail to meet any of our obligations to you, our liability to you shall be limited to the refund of the price paid by the goods by you, if applicable, or the value of the goods ordered by you in the relevant transaction.

To the fullest extent permitted by law, we disclaim any and all warranties of any kind, express or implied in relation to the goods.

We will not be liable in contract, tort or otherwise for any consequential losses arising out of any breach of our obligations or otherwise howsoever arising including (without limitation) loss of goodwill or reputation or special or indirect losses of any kind.  We will not be liable for any failure or delay in delivering or any defect in goods delivered that is caused by any event or circumstance beyond our reasonable control.

The Fotosound website is provided on an ‘as is’ and ‘as available’ basis without any representation as to accuracy or that it will be uninterrupted, timely or error-free, or that it or the server making it available are free of bugs or viruses.  We will not be liable to you for any loss of content or material or data howsoever arising.

Invalidity:
If for any reason any provision of these terms is unenforceable, the validity of the other provisions shall not be affected.

Governing Law And Jurisdiction:
These terms and any contract for goods made between you and Fotosound are governed by the laws of Jersey and the courts of Jersey shall have exclusive jurisdiction in respect of any disputes arising in connection therewith.
